The Law of Trusts is continually changing. Advisors need to ensure that their clients' needs when ordering a trust deed are considered and satisfied. It is not a case of simpler drafting or discounted deeds.

The law is constantly evolving in relation to trusts and advisors need to be comfortable that the deeds they are recommending to their clients are up to date and contain the most relevant clauses and powers for all their clients' needs. The Australian Taxation Office also has voiced their concern recently in relation to hybrid discretionary trusts and the outcome of Bamford v Deputy Commissioner of Taxation. Controller options in a Discretionary Trust
All MGS discretionary trusts (Discretionary and Hybrid Discretionary) come with a Controller OPTION. A controller cannot exercise any power but may be a independent person who must authorise the trustee if it wishes to vary the deed, vest the trust or add beneficiaries. It is an additional estate planning security feature. Ie Dad could appoint a trusted adviser or friend to safeguard mum and his children.
