The Law of Trusts is continually changing. Advisors need to ensure that their clients' needs when ordering a trust deed are considered and satisfied. It is not a case of simpler drafting or discounted deeds. The Australian Taxation Office also has voiced their concern recently in relation to hybrid discretionary trusts and the outcome of Bamford v Deputy Commissioner of Taxation. Controller options in a Discretionary Trust | |
All MGS discretionary trusts (Discretionary and Hybrid Discretionary) come with a Controller OPTION. A controller cannot exercise any power but may be a independent person who must authorise the trustee if it wishes to vary the deed, vest the trust or add beneficiaries.
